Draft amendments to the Assessment Review Board Rules of Practice

The Board is undertaking a consultation process with respect to amendments proposed to the Rules of Practice to add a costs rule to implement its power to award costs under the Statutory Powers Procedure Act. The purpose of the process is to obtain input on the amendments which are intended to modernize the procedures of the Board.

I am requesting your comments on these proposed changes so that your comments can be taken into account before the amendments are finalized.

Please provide your response to the following questions:

1. Are the limitations on the amount of costs and the type of cases in which costs can be awarded appropriate?

2. Are the time limits and timing for the process for requests for costs appropriate?

3. Do the proposed changes violate any of the principles of procedural fairness?
